GORUCK PARTNER PROGRAM TERMS AND CONDITIONS

The GORUCK Partner Program (“Program”) is open only to current, validated CrossFit affiliate licensees of record or GORUCK Club leaders in good standing in the United States and are at least 18 years of age.  Acceptance into the Program entitles eligible participants (up to 2 CrossFit affiliated gym owners/licensees of record in good standing per CrossFit affiliated gym) and up to two GORUCK ruck club leaders (in good standing) per GORUCK club to receive a discount off qualifying, full-priced GORUCK merchandise purchased on www.goruck.com using your valid, authenticated Program account and that is in good standing and current at time of purchase. Offer valid for your qualifying purchase of select GORUCK footwear, apparel and accessories as described in the Program and as determined by GORUCK in its sole discretion. Offer valid at www.goruck.com in the United States and on domestic U.S. orders only.  Offer is limited to one discounted product SKU (i.e., one discounted purchase of Rough Runners) per transaction and may not be transferred. Valid on qualifying purchase of in-stock GORUCK products while supplies last (no rain checks); not valid at third-party retail stores or websites selling GORUCK products or on prior purchases, exchanges or returns.  Offer excludes products, footwear, apparel and accessories not expressly listed as eligible for the applicable Program discount, gift cards, non-GORUCK brand products, sales tax, packaging or shipping costs.  Discount will be reflected on pricing of eligible GORUCK products on website. No promo code required. Stacking not permitted and only one discount is available for qualifying purchases. All purchases are subject to terms and conditions of sale at website.  Offer cannot be combined with any gift card purchases, other coupons, promotions, offers or discounts. GORUCK and CrossFit employees and 3rd party retailers/resellers are not eligible for this offer. Additional exclusions may apply.  No price adjustment allowed on previous purchases or purchases made before or after the promotional period of the Program or otherwise than as described above. If product purchased pursuant to offer is later returned, consumer will not be refunded discount. Not responsible for technological failure/error/malfunction which interferes with conducting offer as intended. Offer not to be republished and has no cash value, cannot be redeemed for cash and cannot be applied as payment or credit to any account. By participating, consumer agrees to these Terms and GORUCK’s decisions, which are final and binding.  No variance from these Terms allowed except as legally required by state law.  Void where prohibited, taxed or restricted. Offer and Program details are subject to change at any time without notice.  Purchase must be made for personal use only and not for re-sale; no bulk purchases permitted. GORUCK reserves the right to limit quantities and the right to cancel orders arising from fraud, bulk purchasing, pricing, promotions, or other errors.

Abuse of the Program may result in cancellation of eligibility and future disqualification from Program or other GORUCK promotional programs.  GORUCK may also prosecute abuse of the Program to the fullest extent of the law. The following are examples of abuse of the Program: (i) failure to abide by these terms or the Terms and Conditions of Use of www.goruck.com,which are incorporated herein by this reference; (ii)  the sale or barter (or the attempted sale or barter) of Program discounts or benefits; (iii) excessive returns of purchases; (iv) fraud or tampering of any kind; or (v)  any misrepresentation of fact relating thereto or other improper conduct as determined by GORUCK in its sole judgment.  

By registering for the Program, or accessing or using the Program and related services, you consent to the collection, use and disclosure of your personal information as described in the GORUCK Privacy Policy, as it may be updated from time to time. In the event of any inconsistency between these Terms and the GORUCK Privacy Policy, these Terms will control. 

General Terms of the Program 

A. The Program is offered at the sole discretion of GORUCK, which reserves the right to terminate, change, limit, modify, or cancel the Program or any Program rules, regulations, discounts, or conditions of participation at any time, with or without notice. In the event of cancellation, to the fullest extent permitted by law, discounts and other benefits will be canceled as determined by GORUCK in its sole discretion.  

B. Electing to remain a participant in the Program after a change in the Terms constitutes your acceptance of the revised Terms. While GORUCK may alert participants to a change in the Terms, GORUCK is in no way obligated to do so and refraining from sending any such notification (or its content) does not create any liability on the part of GORUCK. The revisions to the Program that GORUCK may make include, but are not limited to: (i) increase or decrease of the discount of eligible products; (ii) addition or removal of eligible products; (iii) cease providing a discount; (iv) change the method(s) of qualifying for the Program; (v) institute or add blackout dates or other restrictions on making purchases under the Program; and (vi) termination of the Program, in whole or in part.

Resellers of GORUCK merchandise or customers who make bulk purchases are not eligible for the Program.  GORUCK may refuse to offer or continue offering Program access or services to any person and may change its eligibility criteria from time to time. GORUCK may refuse to accept any application to register for the Program in its sole discretion.

E-mail.  By registering for the Program, you agree to receive transactional and recurring marketing e-mails regarding the Program and general marketing and promotional e-mails about GORUCK from GORUCK. These may include information about Program, discounts, Program updates, and other related materials, including promotional e-mail offers and updates about GORUCK, at the discretion of GORUCK. Members may not unsubscribe completely from transactional e-mails of the Program, but can cancel their participation in the Program as described herein. You may unsubscribe from GORUCK promotional e-mails at any time via the unsubscribe link in those e-mails without affecting your participation in the Program.
