10. Global Privacy Control and Universal Opt-Out Signals

Where required by applicable law, GORUCK honors legally recognized browser-based opt-out preference signals, including Global Privacy Control (“GPC”), as requests to opt out of the sale or sharing of personal information and/or processing for targeted advertising, as applicable.

Because these signals are generally browser- and device-specific, you may need to enable the signal separately on each browser or device you use. If you are a California resident please see the section below on the universal opt out right that may be exercised by visiting the Your Privacy Choices page.

If you are logged into a GORUCK account when a legally recognized opt-out preference signal is received, we may associate the preference with your account where required and technically feasible.

11. Marketing Communications

You may unsubscribe from marketing emails at any time by using the unsubscribe link included in the communication.

You may opt out of marketing text messages by following the opt-out instructions provided in the message or applicable mobile program terms.

Opting out of marketing communications does not prevent us from sending non-marketing communications, such as order confirmations, shipping notices, account notices, warranty communications, security notices, or other transactional or service-related messages.

12. Children and Minors

GORUCK's general ecommerce Services are not directed to children under 13, and we do not knowingly collect personal information online from children under 13 without legally required consent.

If we learn that we have collected personal information from a child under 13 in a manner inconsistent with applicable law, we will take reasonable steps to delete it.

GORUCK does not knowingly sell or share the personal information of consumers under 16 without the affirmative authorization required by applicable law.

GORUCK may offer programs, memberships, events, or other experiences that involve minors. Where a child-directed service is subject to additional privacy requirements, GORUCK will provide any additional notice or obtain consent required by applicable law.

13. Memberships, Promotions, and Other Programs

GORUCK may offer memberships, discounts, promotions, referral programs, giveaways, or other programs that provide benefits to participants.

Participation in these programs may require the collection of personal information necessary to administer the applicable program. Where a program is subject to additional privacy disclosures, consent requirements, or terms, we will provide the applicable notice at or before enrollment.

14. Data Security

GORUCK uses reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, destruction, loss, alteration, or disclosure.

However, no method of transmitting information over the Internet or storing information electronically can be guaranteed to be completely secure. You should use appropriate precautions when using online services, including protecting your account credentials.

15. Third-Party Websites and Services

Our Services may contain links to websites, applications, social media platforms, or services operated by third parties. Their privacy practices are governed by their own policies, not this Privacy Policy.

We encourage you to review the privacy policies of third-party services before providing personal information to them.

16. Additional State Privacy Disclosures

Residents of states with comprehensive consumer privacy laws may have additional rights under applicable state law. GORUCK will provide and honor privacy rights required by the law applicable to an eligible requesting consumer.

California Residents

This section supplements the remainder of this Privacy Policy for California residents and is intended to provide disclosures required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”). Capitalized terms used in this section have the meanings given to them under the CCPA.

Notice at Collection. At or before the time we collect personal information, we provide notice of the categories of personal information collected, the purposes for which the information is collected or used, whether the information is sold or shared, and how long we retain the information or the criteria used to determine retention. The categories of personal information GORUCK has collected during the preceding 12 months, the sources of that information, our business or commercial purposes for collecting, using, retaining, disclosing, selling, or sharing it, and the categories of recipients are described in Sections 1 through 7 above.

California Privacy Rights. Subject to applicable exceptions and verification requirements, California residents may have the right to:

  • know and access personal information;

  • request correction of inaccurate personal information;

  • request deletion of personal information;

  • opt out of the sale or sharing of personal information;

  • limit certain uses or disclosures of sensitive personal information where applicable;

  • exercise applicable rights regarding certain automated decision-making or profiling; and

  • exercise their CCPA rights without unlawful discrimination or retaliation, including without being denied goods or services, charged different prices or rates, or provided a different level or quality of goods or services because they exercised a CCPA right, except as permitted by law.

Sale and Sharing of Personal Information. GORUCK does not sell personal information for monetary consideration. However, certain disclosures involving advertising, analytics, social media, and marketing technologies may constitute a “sale” or “sharing” under the CCPA, including disclosures of identifiers, internet or other electronic network activity information, commercial information, approximate geolocation, and marketing or preference information to advertising and analytics partners. California residents may opt out of sale or sharing through our Your Privacy Choices page and, where required by law, through legally recognized opt-out preference signals. If you have enabled such a signal, we will process it as a request to opt out of the sale and sharing of your personal information where required by applicable law.

How to Submit California Requests. California residents may exercise applicable rights through our Your Privacy Choices page, by emailing team@goruck.com, or by calling 904-351-8294. We may request information that is reasonably necessary to verify your identity and process your request. You are not required to create a new GORUCK account solely to exercise your CCPA rights.

Authorized Agents. California residents may designate an authorized agent to submit a CCPA request on their behalf. We may require proof that the agent has been authorized to act on your behalf and may also require you to verify your identity directly with us or confirm that you provided the agent permission to submit the request.

Sensitive Personal Information. GORUCK does not use or disclose sensitive personal information for purposes of inferring characteristics about California residents. The sensitive personal information we may collect, depending on the interaction, may include account log-in credentials in combination with access credentials, payment-card or payment-account information handled by payment providers, height, weight and age in the sizing tool, and information you submit in connection with warranty, SCARS, customer-service, event, or safety-related communications. We use or disclose sensitive personal information only for purposes permitted by the CCPA, such as providing requested goods or services, processing transactions, maintaining account security, preventing fraud, ensuring safety and integrity, administering customer-service, warranty, SCARS, event, or safety-related services, complying with law, and protecting legal rights. We do not sell or share sensitive personal information for cross-context behavioral advertising. Where the CCPA provides a right to limit certain uses or disclosures of sensitive personal information, California residents may submit a request through our Your Privacy Choices page.

Opt-Out Preference Signals. Where required by the CCPA, GORUCK treats legally recognized opt-out preference signals, including Global Privacy Control, as requests to opt out of sale or sharing for the browser, device, and, where required and technically feasible, the associated account. You have the option using Your Privacy Choices to Opt-out of selling or “sharing” your personal information to all websites you visit through a single step rather than having to make individualized requests to opt out on each website.

Minors. GORUCK does not knowingly sell or share the personal information of California consumers under 16 years of age without the affirmative authorization required by law.

Financial Incentives. GORUCK may offer memberships, discounts, promotions, referral programs, giveaways, or other programs that provide benefits to participants. If a program constitutes a financial incentive or price or service difference under the CCPA, we will provide a Notice of Financial Incentive describing the material terms of the program, the categories of personal information implicated, the value of the benefit, how the value is reasonably related to the personal information, and how to opt in or withdraw.

When we make changes, we will update the “Last Updated” date at the top of this Privacy Policy. Where required by law, we will provide additional notice or obtain consent before materially different uses of personal information.
